Terms of Service
Last updated: August 01, 2026 — DRAFT
1. Who we are
Rentcaar (the "Platform") is a peer-to-peer car-rental marketplace operated in Australia. We connect renters with verified hosts; we are not the renter, the host, or the insurer of any car listed.
2. Eligibility
To use Rentcaar you must be at least 21 years old, hold a valid Australian driver licence (or equivalent recognised in Australia), and have a payment method we can verify. Hosts must additionally hold a current Class 4 CTP policy and a current Certificate of Inspection for every listed vehicle. Uploading these documents earns the optional "Verified Car" badge; the marketplace itself does not block listings without them, but renters are entitled to request verification before accepting a match.
3. Bookings
Each booking creates a binding agreement between the renter and the host. Rentcaar facilitates the agreement, holds the bond, and processes weekly payments — but is not a party to the rental itself.
4. Payments & commission
Renters pay weekly via Stripe; the first weekly charge fires on the pickup date. Rentcaar takes a flat 5% commission on each weekly charge before transferring the remainder to the host's Stripe Connect account. The bond (2 weeks' rent) is held on the Platform balance and refunded to the renter on completion of the booking term, subject to the dispute provisions below. Commission and bond rates are configurable in the platform settings and the rate in force at the time of booking is what applies to that booking.
5. Cancellation & refunds
Renters may end a booking early at any time; the bond is refunded in full and the subscription cancels at the end of the current paid week. The current week's rent is non-refundable. No-shows (no collection within 24 hours of pickup) result in the bond being paid to the host and the booking auto-cancelled.
6. Disputes
For damage, fines, or breach of booking terms, hosts may file a Bond Claim through the Platform. Rentcaar admin reviews each claim and decides on a full, partial, or no payout from the bond. For amounts above the bond, Rentcaar may charge the renter's saved payment method off-session or escalate to insurance.
7. Liability
To the maximum extent permitted by Australian Consumer Law, Rentcaar is not liable for personal injury, property damage, or loss arising from the use of any vehicle booked through the Platform. Hosts and renters carry the rental risk, supported by the host's Class 4 CTP and (recommended) comprehensive cover.
8. Modification
We may update these terms; material changes will be communicated by email. Continued use after notice constitutes acceptance.
